Received a letter before claim? What it means and how to reply
A letter before claim is the creditor’s last formal step before court. The rules give you 30 days and a reply form — use both.
Applies to: England & Wales
What to do now
- Count 30 days from the date of the letter — the letter checker shows the date.
- Fill in the reply form. If you agree the debt, complete the financial statement and offer what you can afford.
- If you do not recognise the debt, ask for documents with a CCA request or dispute letter.
What the letter must include
- The amount owed, and whether interest or charges continue.
- Where the debt was assigned, the original creditor and the date of assignment.
- The information sheet, reply form and financial statement from the Protocol.
- How to pay, and an address to reply to.
If these are missing, say so when you reply. A court can take a creditor’s failure to follow the Protocol into account.
Replying
You agree the debt: tick that on the reply form and offer affordable instalments using the financial statement. You need documents: ask for them; the creditor should provide them, or explain why not, and should not start court proceedings until at least 30 days after it has provided them. You need advice: say so — if you cannot get it within the 30 days, the creditor should allow reasonable extra time. You dispute it: explain why, briefly.

Common questions
How long do I have to reply to a letter before claim?
30 days from the date of the letter of claim under the Pre-Action Protocol for Debt Claims. Use the reply form that came with it.
What if I need more time to get debt advice?
Say so on the reply form. If you cannot get advice within 30 days, the creditor should allow reasonable extra time before starting court action.
Can the creditor go to court if I reply?
Yes, if you cannot agree, but replying shows you engaged, can resolve the dispute or agree payments, and the court will expect the creditor to have considered your reply.
